These Terms & Conditions govern your use of the iShopDesi website (ishopdesi.com) and the iShopDesi mobile applications (collectively referred to as the Site). They also outline your relationship with I Shop Desi Limited (iShopDesi, we, our, or us). Please read these Terms carefully, as they describe your rights and responsibilities when using our services.

If you do not agree with any part of these Terms, we kindly ask that you discontinue using the Site and the iShopDesi application.

To purchase products through our platform, you must first register as an authorised user. Additional terms may apply to registered users and specific services. Please ensure you review all applicable Terms before creating an iShopDesi account or placing an order.

As a consumer, you may also have certain legal rights when ordering items through our Application. Further details can be found at the Citizens Advice website: https://www.citizensadvice.org.uk/consumer/. These legal rights operate alongside our Terms and are not replaced or limited by them.

By creating an iShopDesi account, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

1. About Us

The website ishopdesi.co.uk is operated by ISHOPDESI Ltd, a company registered in England and Wales. Our registered office is located at 830A High Road, Leyton, E10 6AE, London, United Kingdom.

2. Objective

Our goal is to connect you with the local businesses we partner with (Partners) so that you can:

  • Purchase the products (Items) you need, and
  • Have those Items delivered to the location you choose.

When you place an order with a Partner, you are purchasing directly from that Partner. iShopDesi acts as their agent, facilitating the order through our Application and supporting you throughout the process. In simple terms, our Partners are responsible for preparing and fulfilling your order, while we provide the platform that enables you to place the order and we collect payment on the Partners behalf.

In addition to purchasing Items, you are also purchasing a delivery service. How delivery is arranged will depend on who provides that service:

  • iShopDesi Delivery: In some cases, delivery will be organised by iShopDesi. If so, your delivery contract is with iShopDesi, and we will arrange delivery using independently contracted delivery partners.
  • Partner Delivery: In other cases, delivery may be managed directly by the Partner. When this happens, you enter into a delivery contract directly with that Partner, and iShopDesi simply acts as the agent processing the transaction on their behalf.

3. Your Account

Account Creation:
To place orders for Items through the iShopDesi Application, you must first create an iShopDesi account. During registration, you may be asked to create a password and provide payment details, such as a credit card. You are responsible for keeping your password secure and preventing unauthorized access to your account, email, or mobile device. Any purchases made by someone using your account or phone will be your responsibility, unless such access occurred due to iShopDesi failing to keep your information secure. You must use a valid email address and are permitted to have only one account per customer.

Account Closure and Suspension:
You may close your account at any time by requesting closure via your account settings on the website or by contacting our support team. We reserve the right to suspend or permanently close your account if we believe it has been accessed by an unauthorized person or if, in our reasonable opinion, you are abusing the Service. Examples of abuse may include:

  • Making repeated unreasonable complaints
  • Requesting refunds or credits to which you are not entitled
  • Mistreating our staff or delivery partners
  • Placing bulk orders for potentially hazardous items
  • Any other conduct that gives us good reason to act

In the event of permanent closure, any valid remaining account credit will be refunded via your registered payment method or, if necessary, via bank transfer using details you have provided.

Verification and Security Measures:
iShopDesi reserves the right to request further verification of your identity, age, or other relevant details when reasonably necessary to protect against fraudulent or illegal activity, or where we believe there may be a risk of breaching applicable laws or regulations. You must provide any requested information promptly. If you refuse or if we suspect fraudulent or criminal activity, your account may be suspended or closed. All information collected will be handled in accordance with our Privacy Policy

4. Service Availability

Each Partner operates within a defined delivery area, which may change from time to time due to factors such as weather conditions, demand, or operational considerations. These adjustments help ensure that the Items you order are delivered in the best possible condition.

Each Partner also sets their own operating hours, which means that the availability of our Serviceand the range of Partners you can order fromdepends on the Partners in your location.

If you attempt to place an order outside a Partners delivery area or operating hours, or if the Application is temporarily unavailable for any reason, we will notify you and your order will not be processed.

5. Orders

You must be 18 years of age or older to use our Site and Services. By placing an order through the iShopDesi Application, you confirm that you meet this age requirement.

All orders placed through our Application must be accepted by iShopDesi or the relevant Partner before they are confirmed. Once your order is accepted, we will send you a Confirmation Notice, which signifies that a contract for the supply of the ordered Items has been formed.

You are responsible for paying for all Items ordered through your account, including any associated delivery or service charges, and for complying with these Terms, even if the order is placed on behalf of another person. Some Partners may have a minimum order value, which will be displayed within the Application. Please note that all Items are subject to availability.

While our Partners make every effort to provide safe and high-quality products, iShopDesi cannot guarantee that any Items are free from allergens. We are not responsible for the preparation of Items by our Partners, and cannot ensure that Items will be allergen-free. It is your responsibility to inform the Partner of any allergies or food intolerances before placing your order.

6. Delivery

When placing an order, you can choose either an ASAP Delivery or a Scheduled Delivery:

  • ASAP Delivery: We will provide an estimated delivery time before you place your order and will aim to deliver your Items as quickly as possible. You must be available to receive your delivery from the time you place the order.
  • Scheduled Delivery: We will inform you of the expected delivery time. You must be available to accept delivery within the estimated time window.

Delivery times may vary due to factors such as preparation time, traffic, weather conditions, or Rider availability. Please check the iShopDesi Application for the most accurate delivery estimates.

Despite our best efforts, delays can occur. If your order arrives more than 15 minutes later than the latest estimated delivery time, we will investigate the cause. If we determine that the delay was due to iShopDesi or our service, we may, at our sole discretion, offer compensation.

We will deliver to the address provided when placing your order. If you need to change the delivery address after placing your order, we may be able to update it to an alternative address registered to your account, provided:

  • The Partner has not yet started preparing your order, and
  • The new address is within the same delivery zone as the original address.

You remain responsible for payment for the Items and any delivery charges if a delivery fails due to reasons within your control. Such reasons may include, but are not limited to:

  • Not answering the door, not providing a handover code, or failing to answer the phone when contacted by the Rider;
  • Failing to provide access to a safe delivery location in a reasonable timeframe;
  • The Rider refusing delivery in accordance with Section 8 (Age-Restricted Products).

If a delivery failure occurs due to your actions, you may also be responsible for the cost of non-refundable Items such as fresh meat or vegetables, as well as any delivery or service fees. Please refer to the relevant Partners refund and cancellation policy for their terms, and to Section 9 (Cancellation) for iShopDesi Delivery orders

7. Consumer Rights for Faulty Items or Services

As a valued customer, you are legally entitled to receive goods that:

  • Match their description,
  • Are of satisfactory quality, and
  • Meet any specific requirements you have informed us of (and we have agreed to) before you placed your order.

You also have certain rights regarding the services you receive, including the expectation that they are carried out with reasonable care and skill.

If you believe that the Items delivered or services provided do not meet these standards, please contact us. We may request additional details or a photograph of the issue to help assess the problem, particularly if it is visible upon inspection of the Items.

For Items purchased from our Partners, we will refer you to the relevant Partner, who will assist in resolving the matter. For Items eligible for return, you will need to return them to the Partner, and either we or the Partner will guide you through the process.

8. Age and Regulation Requirements for Certain Products

iShopDesi does not sell alcohol on our platform. Other age-restricted products, including (but not limited to) tobacco and cigarettes, may only be purchased and delivered to individuals aged 18 or over. By placing an order for an age-restricted product, you confirm that you meet this age requirement.

For iShopDesi Delivery, our drivers follow a strict age verification policy. Customers ordering age-restricted products may be asked to show valid photo ID before the delivery is completed.

For Partner Delivery orders, our Partners are responsible for implementing their own age verification policies. Delivery personnel may decline to deliver age-restricted products if the recipient is unable to provide valid photo ID confirming they are 18 or older. Please note that if a delivery is refused due to age verification, the cost of the Item and any delivery fees will still apply.

Some of our Partners may also offer traditional or herbal medicines through iShopDesi. These products are sold directly by the Partner, and details regarding their registration to sell these medicines can be found in the Info section of the relevant menu pages.

9. Cancellation

If you place a grocery order, you may cancel it free of charge at any time before the Partner has started packing the order (a Started Order). To cancel an order that has not yet become a Started Order, please contact us immediately through the iShopDesi Application. If the Partner confirms that the order was not a Started Order, your payment will be refunded (excluding any discount or Voucher appliedplease see our Voucher and Account Credit Terms for details).

If you cancel an order after it has become a Started Order, you will be charged the full price of the Items. Additionally, if a driver or rider has already been dispatched, delivery charges will also apply.

iShopDesi and our Partners may also cancel an order on their own at any time. In such cases, you will not be charged, and any payment already made will be reimbursed using the same method you used to pay. We may also apply account credit to compensate for any inconvenience caused.

For non-perishable Items purchased from a Partner, you generally have the legal right to change your mind within 14 days and receive a refund, subject to certain exceptions. These exceptions include Items that are likely to expire or deteriorate quickly (e.g., ready-to-eat food) or cannot be returned for hygiene reasons.

For full details on returning Items and obtaining a refund, please refer to the refund or cancellation policy of the Partner from whom you purchased the Item. Partner policies can be found on their website or in the Info section of their iShopDesi menu.

0. Prices, Payment, and Offers

10.1 Prices

All prices displayed on iShopDesi include VAT. Our Service is intended for personal, non-commercial use only.

While most prices are static, iShopDesi may occasionally use dynamic pricing, meaning prices for Items or delivery may change while you are browsing. Partners may also adjust prices at their discretion.

You will always be notified of any applicable service fees and taxes on the checkout page before completing your order.

Price changes will not affect existing confirmed orders, except in cases of obvious pricing errors. For orders in progress within your basket:

  • If you complete your order within 2 hours, the prices shown will apply.
  • If the order is not completed within 2 hours, Items will be removed from your basket, and updated prices will apply.
  • If we detect a clear pricing mistake, we will notify you promptly. You will then have the choice to either:
  • Confirm the order at the original price, or
  • Cancel the order free of charge, with a full refund of any payment already made.

Where iShopDesi or a Partner provides delivery, a delivery fee may apply. This will be displayed during the order process before you complete your order.

The total price of your order, including Items, delivery fees, service charges, and taxes, will be clearly shown on the checkout page.

10.3 Payment Methods

Payments for all Items and deliveries can be made through the Application using: Credit or debit card, or Other payment methods made available by iShopDesi. Once your order is confirmed, your card will be authorised and the total amount marked for payment. Payments are made to iShopDesi, acting as agent on behalf of the Partner. Using vouchers or account credit is also possible, subject to our Voucher and Account Credit Terms. Where permitted, you may alternatively pay in cash directly to the Partner via the rider at the time of delivery. This option, if available, will be clearly indicated in the Application before placing your order.

10.4 Special Offers

Partners may occasionally provide special offers visible within their menu on the Application. These offers are at the Partners discretion and may be withdrawn at any time, unless: The offer specifies a fixed or minimum period, or You have already placed an order based on the offer and received a Confirmation Notice.

11. Our Liability for Loss or Damage

11.1 General Responsibility

iShopDesi is responsible for any loss or damage that you suffer which is a foreseeable result of: Our failure to comply with these Terms, or Our failure to exercise reasonable care and skill when providing our Service. A loss or damage is considered foreseeable if it is either obvious that it could occur, or if you informed us beforehand of particular circumstances that might increase the risk of loss or damage when placing your order.

11.2 Limitations of Liability

We do not exclude or limit liability where it would be unlawful to do so. This includes responsibility for: Death or personal injury caused by our failure, or the failure of our employees, agents, or subcontractors, to use reasonable care and skill, Fraud or fraudulent misrepresentation, Breach of your legal rights regarding Items (as outlined in Section 7), or Defective Items under the Consumer Protection Act 1987. Subject to the above, iShopDesi is not responsible for any loss or damage: Resulting from your own breach of these Terms, or Arising from IT hardware or software failures, except for failures within our Application.

13. Miscellaneous Terms

13.1 Enforcement of Rights

Any right that either you or iShopDesi has to enforce these Terms will not be lost due to a delay in exercising that right or if it is waived on any particular occasion.

13.2 Severability

If any part of these Terms is found to be illegal, invalid, or unenforceable by a court or other authority, the remaining provisions will remain in full force and effect.

13.3 Changes to Terms

iShopDesi may update or modify these Terms from time to time. If any changes affect your rights regarding our Service, we will notify you. Changes to the Terms will not affect any orders for which we have already sent a Confirmation Notice.

13.4 Governing Law and Jurisdiction

These Terms are governed by English law. You may bring legal proceedings in the English courts regarding our Service. If you live in Scotland, you may bring proceedings regarding Items in either the Scottish or English courts. If you live in Northern Ireland, you may bring proceedings regarding Items in either the Northern Irish or English courts.

These Terms of Use explain the rules and guidelines for using our website, ishopdesi.co.uk (the Site), and any applications we make available via app stores or other means (together, the Service), whether you are a guest or a registered user. Please read these Terms carefully before using our Site or Service. By accessing our Site or using our Service, you confirm that you accept these Terms of Use and agree to abide by them. If you do not agree, please do not use the Site or Service.

2. Accessing Our Service

Access to our Site and Service is temporary and may be withdrawn or amended at any time without notice. You must be 18 years or older to use our Site or Service. We are not liable if the Site or Service is temporarily unavailable. From time to time, we may restrict access to certain parts of the Site or Service to registered users only. You are responsible for keeping your login credentials secure and for all activities under your account. If you suspect unauthorized use, contact support@ishopdesi.co.uk immediately. We reserve the right to deactivate your account if necessary.

3. Acceptable Use

You may use our Service only for lawful purposes. You agree not to: Breach any local, national, or international law or regulation. Upload, download, or reuse material that does not comply with our content standards. Access without authority, interfere with, damage, or disrupt any part of the Site, Service, or associated networks and equipment.

4. Suspension and Termination

Failure to comply with Section 3 may result in: Temporary or permanent withdrawal of your right to use the Service. A formal warning. Legal action, including recovery of reasonable administrative and legal costs. Disclosure of information to law enforcement if deemed necessary. We may also take any other action we reasonably consider appropriate.

5. Intellectual Property Rights

All intellectual property rights in the Site, Service, and material published (excluding your contributions) are owned by iShopDesi or licensed to us. These works are protected worldwide by copyright law. You may use content for your personal, non-commercial use only. Any other use, including copying, reproducing, posting, transmitting, or broadcasting, is prohibited without our prior consent.

6. Our Site and Service Content

We aim to keep our Site and Service updated but may change, suspend, or discontinue them at any time. Material on the Site or Service may occasionally be out of date, and we are not obliged to update it.

7. Our Liability

We have made every effort to ensure the accuracy of our Site and Service. However: We are not responsible for errors, omissions, or technical issues. We will attempt to correct any inaccuracies promptly once identified. To the extent permitted by law, we exclude liability for any loss or damage arising from your use of our Site, Service, linked sites, or posted materials. This does not affect our liability for: Death or personal injury caused by our negligence. Fraud or fraudulent misrepresentation. Breach of your legal rights regarding items purchased.

8. Data and Privacy

We collect certain data about your use of the Service. Details are provided in our Privacy Policy, which you should review carefully.

9. User-Generated Content

Any material you upload or provide to us is considered non-confidential. You grant iShopDesi a perpetual, worldwide, royalty-free licence to use, copy, modify, distribute, or disclose such material for purposes related to our business.

Our Site may contain links to third-party websites. These links are for convenience only. We have no control over the content of those sites and are not responsible for any loss or damage resulting from their use.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. You may bring legal proceedings in the English courts. Residents of Scotland may bring proceedings in either Scottish or English courts. Residents of Northern Ireland may bring proceedings in either Northern Irish or English courts.

12. Changes to Terms

We may update or modify these Terms from time to time. Material changes affecting your rights will be communicated to you. Changes do not affect any confirmed orders for which we have sent a Confirmation Notice.

iShopDesi Pick-Up Order Terms and Conditions

Please read these Terms carefully before placing any Pick-up Orders via our Application. If you have any questions regarding these Terms, please contact support@ishopdesi.co.uk before placing a Pick-up Order. If you are a consumer, you have certain legal rights when ordering Items using our Application. These Terms are in addition to your legal rights and do not replace them. By creating an iShopDesi account, you confirm your acceptance of these Terms.

1. Placing Pick-Up Orders

Pick-up Orders placed through our Application must be accepted by us or the Partner Store before they are confirmed. Orders may be rejected at any time, for example, if the Partner Store is too busy or the Items ordered are temporarily unavailable.

Once your order is accepted, you will receive a Confirmation Notice, at which point a contract for the supply of the Items comes into effect. You are responsible for paying for all Items ordered using your account and for complying with these Terms, even if you order on behalf of someone else.

Some Partner Stores may operate a minimum order value policy, which will be displayed in our Application. All Items are subject to availability.

2. Pick-Up Time

After a Pick-up Order is accepted, the Partner Store will provide the estimated time your Items will be ready. You must collect your Items directly from the Partner Store at or just before the scheduled pick-up time.

Partner Stores will hold your Items for 60 minutes after the scheduled pick-up time. If you fail to collect your Items within this window, the Partner Store may cancel or dispose of them, and you will still be charged for the Items.

While we and our Partner Stores strive to ensure timely preparation, there may be occasions when Items are not ready at the scheduled time. If your order is delayed by more than 15 minutes, we will work with you to resolve the issue unless the delay was caused by you (e.g., changes to your Pick-up Order after confirmation).

3. Your Rights if Items Are Faulty

You have a legal right to receive goods that match their description, are of satisfactory quality, and meet any specific requirements you communicated prior to placing your order.

If you believe the Items you collected do not comply with these rights, please inform us immediately. We may request a photograph of the problem. We will provide a refund or account credit for the affected part of the order unless we have reason to believe the issue arose after pick-up.

In evaluating your refund or account credit, we may consider order details, account history, the circumstances of pick-up, and any relevant information from the Partner Store.

4. Age-Restricted Products

iShopDesi does not sell alcohol. All other age-restricted products (including tobacco and cigarettes) are only available to persons aged 18 or over. By placing a Pick-up Order for an age-restricted product, you confirm that you are at least 18 years old.

Partner Stores may require proof of age via valid photo ID and may refuse to sell any age-restricted Item if proof cannot be provided. If a sale is refused, iShopDesi will issue a refund to the card used for payment. Cash payments will be refunded by the Partner Store directly.

5. Cancellation of Pick-Up Orders

You may cancel a Pick-up Order without charge at any time before the Partner Store has started preparing the order (Started Order). To cancel, contact us immediately via the Application.

If the Partner Store confirms the order was not a Started Order, we will refund your payment (excluding discounts or vouchers applied; see Voucher and Account Credit Terms).

If you cancel after the order has become a Started Order, you will be charged the full price of the Items.

Pick-up Orders may also be cancelled by iShopDesi or the Partner Store. In such cases, you will not be charged, and payments already made will be refunded via the same method used for the order. Credit may also be applied to your account to reflect any inconvenience.

6. Our Responsibility for Loss or Damage

We are responsible for any foreseeable loss or damage resulting from our breach of these Terms or from failing to exercise reasonable care and skill in providing the Service.

Loss or damage is foreseeable if it is obvious or if you informed us of circumstances that may increase the risk of loss before placing an order.

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury, fraud, fraudulent misrepresentation, breach of legal rights in relation to the Items, or defective Items under the Consumer Protection Act 1987.

We are not liable for losses arising from your own breach of these Terms or from IT hardware/software failures not caused by our Application.

We process your personal data in accordance with our Privacy Policy.

8. General Terms

Rights under these Terms are enforceable even if delayed or waived in any instance. If any provision is found to be unlawful or unenforceable, the remaining Terms will continue in full effect.

We may update these Terms from time to time. Any changes affecting your rights will be communicated to you. Updates will not affect orders already confirmed via the Confirmation Notice.

These Terms are governed by English law. You may bring legal proceedings in English courts. Residents of Scotland or Northern Ireland may choose to bring proceedings in either their local courts or the English courts.

iShopDesi Vouchers, Account Credit, and Perishable Products Terms

These terms govern the use of Vouchers, Account Credits, and our Perishable Products Promise when using the iShopDesi Service. Please read them carefully.

1. Introduction to Credits

iShopDesi provides two types of credits: Vouchers promotional credits offered by iShopDesi or Partner Stores via our Site. Account Credits credits applied to your account at iShopDesis discretion. Both Vouchers and Account Credits (collectively, Credits) can be redeemed against the cost of Items in your iShopDesi account, subject to the conditions below. These Credit Terms apply alongside the iShopDesi Terms of Service. In the event of any conflict, these Credit Terms take priority. Capitalized terms used here have the same meanings as in the Terms of Service unless defined otherwise. You can apply a Voucher to your account by entering a Voucher code at checkout or by selecting any reward in the Your Offers and Rewards section of your account. Once applied, a Voucher remains on your account until redeemed or expired. Account Credits are applied directly by iShopDesi. Credits remain available until used, lost, or, in the case of Vouchers, expired in accordance with the applicable Voucher terms.

2. Voucher Terms

Vouchers are generally subject to specific conditions, such as: Time limits Geographic restrictions Customer category restrictions (e.g., new customers) Partner Store or menu item restrictions New Customer Vouchers: Some Vouchers are only available to new iShopDesi customers. These Vouchers are applied automatically when a new account is registered and redeemed on the first eligible order. iShopDesi reserves the right to refuse redemption if account details match existing accounts. Voucher Usage Rules: Only one Voucher can be redeemed per order. Each Voucher may only be used once per customer. If multiple Vouchers are available, they will be redeemed in order of earliest expiry. If an order paid with a Voucher is cancelled, the Voucher cannot be restored. New Customer Vouchers cannot be reissued.

3. General Terms for Vouchers and Account Credits

Credits cannot be exchanged for cash or alternatives and have no monetary value (except as required by law). Any attempt to manipulate the Service or redeem Credits fraudulentlyincluding bulk entry, macros, automated scripts, IP manipulation, or use of false identitieswill void the order and the Credit. iShopDesi may take reasonable steps, including account verification or closure, to prevent abuse. Credits cannot be redeemed for infant formula, baby milk products, milk powder, or other restricted items.

4. Perishable Products Promise

Scope: This promise covers select fresh and chilled Items, including:

  • Fruit & vegetables
  • Bakery items
  • Meat, poultry, and seafood
  • Eggs, dairy, and dairy alternatives
  • Other fresh grocery items available from iShopDesi Partner Stores

Satisfaction Guarantee: If you order a perishable Item and:

  • You are not satisfied that it meets our standards (as detailed in our FAQs), or
  • The Item’s best-before date is the day of delivery or the next day (excluding certain naturally short shelf-life items listed in our FAQs)

you may request a refund or account credit. If a product has multiple expiry dates, the later date will be used.

  • Go to Order History in your account, select the relevant order, and use Order Help, or
  • Contact us at support@ishopdesi.co.uk

You may choose either a refund to your original payment method or an account credit for use on future orders.
